Tribal Court Database Terms of Use

1) TRAUMA CONSIDERATIONS. The information available on the Tribal Court Case Database includes discussion of suicide, other causes of death, chemical dependency, abuse, and trauma. Please care for yourself while you review this information. If you need help, please reach out to someone.

2) BY ACCESSING OR USING THE TRIBAL COURT CASE DATABASE, YOU CERTIFY that you have read, understood, and accept these Terms of Use and all other application policies. You agree to comply with these Terms of Use and the other policies, as well as all applicable laws, court rules, regulations, and court orders.

This application and website are the property of the Prairie Island Indian Community and are protected by copyright and other restrictions. The Prairie Island Indian Community grants users a limited license to print orders from the Tribal Court Case Database for the use in and preparation for Prairie Island Indian Community Tribal Court proceedings. Any unauthorized reproduction, commercial publication, or exploitation of any text, images, or content of the application and website are strictly prohibited. Your access to and use of this application, and the content contained therein, may be terminated at any time without notice. By using this application, you understand and agree that information regarding your access to and use of the Tribal Court Case Database may be received and stored by the Prairie Island Indian Community. The Prairie Island Indian Community reserves the right to receive and store such information consistent with its practices and policies currently in place and as adopted and implemented in the future.

The Prairie Island Indian Community publishes the Tribal Court Case Database as a courtesy and does not require any person to access the Database. Whether to access the Tribal Court Case Database is solely the decision of the user. By using this application, you understand and agree that you have entered a consensual relationship with the Prairie Island Indian Community, and that you submit to the jurisdiction of the Prairie Island Indian Community Tribal Court for any matters concerning your access to or use of the Tribal Court Case Database.

3) UNOFFICIAL RECORDS. The information available on the Tribal Court Case Database is provided as a service and is not considered an official court record. The Community Council and Tribal Court do not certify the Tribal Court Case Database records or search results and are not responsible for any errors or omissions in the data found on the Tribal Court Case Database.

The Clerk of Court maintains the official unredacted court records of all proceedings.

4) READ THE TRIBAL COURT CASE DATABASE USER GUIDE

Read the Tribal Court Case Database User Guide and other training materials for more information before using the Case Database. This information is available at LINK.

5) YOU MAY NOT DO ANY OF THE FOLLOWING:

    a) Use information from this Case Database to harass, injure, defame, derogate, or otherwise harm any person;

    b) Violate any copyright and other proprietary or intellectual property rights in connection with this Case Database;

     c) Engage in any data mining or use “bots” or similar data gathering and extraction tools or methods in connection with this Case Database;

     d) Decompile, reverse engineer, disassemble, lease, sell, distribute, or reproduce this Case Database;

     e) Transmit, post, or otherwise make available: (i) content that is unlawful, false, inaccurate, harmful, obscene, or otherwise objectionable, including but not limited to, any content that infringes on any intellectual property or proprietary rights; (ii) viruses, Trojan horses, or other harmful programs or material; or (iii) advertising or promotional materials, “spam,” or any other form of solicitation;

     f) Misrepresent your affiliation with or impersonate any person or entity;

     g) Interfere with or disrupt this application or attempt to circumvent this application and website’s security features;

     h) Remove or modify any copyright notices, other proprietary notices, or references contained in this Case Database;

     i) Alter content from this Case Database

     j) Misrepresent content from this Case Database or misinform others (whether by affirmative statement or omission) about the origin or ownership of this Case Database;

     k) Use the application in any manner which could damage, disable, overburden, or impair the Case Database, or interfere with any other party’s use of the application; and

     l) Use the application for any purpose that is unlawful or prohibited by these Terms of Use and all applicable laws, court rules, regulations, court orders and policies.

Any use of the Tribal Court Case Database that is prohibited under this section is a violation of these Terms of Use, and could result in termination of your access to and use of the Database. If the use is a violation of Community or State law, that use may also result in civil and criminal actions against you.”

 6) CAUTION: NAME SEARCHES CAN BE UNRELIABLE. Use caution in evaluating Tribal Court Case Database data. A person you search for could have the same name or other identifiers as another individual or may have changed their name.

7) CAUTION: SEARCHES FOR REDACTED INFORMATION CAN BE UNRELIABLE. Use caution in evaluating Tribal Court Case Database data. If a person you have searched for was in a case, but their name fit within the redaction rules, their name will not appear in the case name or in your search. None of the redacted personal information will appear in searches, and you WILL NOT be notified that your search yielded confidential results.

8) CAUTION: LIMITED CASE RECORD INFORMATION AVAILABLE. The information available on the Tribal Court Case Database is limited to:

     a) All appellate orders (except scheduling orders) regardless of date; and

     b) All trial court orders issued after January 1, 2010 except scheduling orders, orders summarizing a party’s legal status but not making any decision, and memoranda directing distribution of court-supervised funds.

The Community has made every effort to include all orders that meet these publication criteria in the database. Nevertheless, because of the limitations of pre-electronic recordkeeping, the volume of orders included in the initial database, and the time to process an order after it was issued and before it is uploaded, the Court and Community Council do not warrant that every order within these categories will be available in the database. Contact the Clerk of Court if you believe that the database is missing an order that should be published.

9) YOU ARE RESPONSIBLE for understanding the meaning of the case record information and documents that you view through the Tribal Court Case Database and for the appropriate and lawful use of this information. By certifying your agreement with these Terms of Use, you agree that you will not use information from this Case Database to harass, injure, defame, or derogate, or otherwise harm any person.

If you have any questions regarding the meaning of the case information on the Tribal Court Case Database, contact your attorney or the Clerk of Court. You are also responsible for determining whether any case record information obtained from the Tribal Court Case Database during previous searches is still accurate, current, and complete.

10) ERRORS. You agree that use of the application may not be uninterrupted or error-free. If you see errors with the case information or documents in the Tribal Court Case Database, please notify the Clerk of Court.

11) FEEDBACK. The Tribal Court and Community Council welcome comments, suggestions and questions regarding this Tribal Court Case Database. Please direct your feedback to the Clerk of Court. All comments and suggestions will be reviewed, but please note that a personal response to all submissions may not be possible.

12) ACCESSIBILITY. The Prairie Island Indian Community is committed to providing all people with equal access to the courts, and makes reasonable efforts to comply with accessibility standards and provide information in an accessible format. If you are having accessibility issues with this application, please report the issue to the Clerk of Court.

13) SOVEREIGN IMMUNITY. Nothing in these Terms of Use or the creation or operation of the Tribal Court Case Database may be interpreted as a waiver of the Prairie Island Indian Community’s sovereign immunity from suit.
